Environmental impact assessment, abbreviated as EIA (or EIA in English) is the process of analyzing, evaluating, and forecasting the environmental impacts of projects on natural, economic and social objects in the project area. From there, choose feasible and economically and technically optimal environmental impact mitigation options to protect the environment when implementing the project.
Prepare environmental impact assessment report

Subject of implementation

Production and business projects with a scale specified in Appendix II of Decree No. 18/2015/ND-CP dated February 14, 2015 of the Government regulating environmental planning, environmental impact assessment, and environmental protection plans.
Construction and operation have not yet commenced.
The project has had its environmental impact assessment report approved, but during the implementation process, there is one of the following changes in scale, capacity, technology, or other changes that result in environmental protection works being unable to resolve increasing environmental issues;
Legal basis
Law on Environmental Protection No. 55/2014/QH13 was passed by the National Assembly of the Socialist Republic of Vietnam on June 23, 2014, effective from January 1, 2015.
Decree No. 18/2015/ND-CP dated February 14, 2015 of the Government regulating environmental planning, environmental impact assessment, environmental protection plans.
Circular No. 27/2015/TT-BTNMT dated May 29, 2015 of the Ministry of Natural Resources and Environment detailing environmental protection planning, strategic environmental assessment, environmental impact assessment and environmental protection plans, effective from July 15, 2015, resolving increasing environmental issues.

Required documents

Business registration certificate/Investment license.
Construction site agreement.
Land use right certificate/Land lease contract.
Investment report/Technical economic explanation/Pre-feasibility study report.
Project location diagram.
General plan, rainwater drainage, wastewater.
Drawings of environmental treatment systems (if any).

Application dossier

The application dossier for appraisal includes:
One (01) written request for appraisal of the environmental impact assessment report made according to the form prescribed in Appendix 2.1 of Circular No. 27/2015/TT-BTNMT.
Seven (07) copies of the environmental impact assessment report of the project. In case the number of appraisal council members is more than seven (07), the project owner must provide an additional number of environmental impact assessment reports. The form of the cover page, sub-cover page and requirements on the structure and content of the environmental impact assessment report are made according to the corresponding forms prescribed in Appendixes 2.2 and 2.3 of Circular No. 27/2015/TT-BTNMT.
One (01) copy of the feasibility study report or investment project report or other equivalent documents.

Time for appraisal and approval of dossiers

The maximum appraisal period is thirty (30) working days from the date of receipt of a complete and valid dossier. In case the dossier is incomplete or invalid, within a maximum period of five (05) working days from the date of receipt of the dossier, the appraisal agency shall issue a written notice to the project owner. The appraisal period for the environmental impact assessment report does not include the time for the project owner to complete the environmental impact assessment report as required by the appraisal agency.
The maximum approval period for the environmental impact assessment report is twenty (20) working days from the date of receipt of a complete and valid dossier.

Receiving and appraising agency

Depending on the scale and location of the project, the receiving and appraising agency is one of the following agencies:
Ministry of Natural Resources and Environment.
Other ministries.
Department of Natural Resources and Environment.
Industrial Park Management Board.
Economic Zone Management Board.

Approval Authority

Depending on the scale, the licensing authority is one of the following agencies:
Ministry of Natural Resources and Environment.
Other ministries.
Provincial People's Committee
Industrial Park Management Board
Economic Zone Management Board.

Penalty for violations

A fine of VND 200,000,000 to VND 250,000,000 for the act of not having an approved Environmental Impact Assessment Report as prescribed.
A fine of VND 180,000,000 to VND 200,000,000 for the act of not re-establishing an Environmental Impact Assessment Report.
Detailed penalty provisions are in Articles 9 and 12, Decree 179/2013/ND-CP dated November 14, 2013 of the Government regulating administrative sanctions in the field of environmental protection.
