Legal basis
Law on Environmental Protection No. 55/2014/QH13 was passed by the National Assembly of the Socialist Republic of Vietnam on June 23, 2014, effective from January 1, 2015.
Decree No. 18/2015/ND-CP dated February 14, 2015 of the Government regulating environmental planning, environmental impact assessment, and environmental protection plans.
Circular No. 27/2015/TT-BTNMT dated May 29, 2015 of the Ministry of Natural Resources and Environment detailing environmental protection planning, strategic environmental assessment, environmental impact assessment and environmental protection plan, effective from July 15, 2015.

Proposal documents
The dossier for registration of the environmental protection plan under the registration confirmation authority of the Department of Natural Resources and Environment includes:
Three (03) copies of the environmental protection plan with cover page and content requirements according to the corresponding form specified in Appendices 5.4 and 5.5 of this Circular;
One (01) investment report or production, business and service plan.
The dossier for registration of the environmental protection plan under the registration confirmation authority of the District People's Committee includes:
Three (03) copies of the environmental protection plan with structure and content requirements according to the form specified in Appendix 5.6 of this Circular;
One (01) investment report or production, business and service plan of the project owner.
Time for appraisal and approval of dossiers
Within ten (10) working days from the date of receipt of the dossier for registration of the environmental protection plan, the dossier receiving agency shall be responsible for reviewing and confirming the registration of the environmental protection plan according to the form prescribed in Appendix 5.7 of Circular No. 27/2015/TT-BTNMT. In case of non-confirmation, a written notice must be issued stating the reasons according to the form prescribed in Appendix 5.8 of Circular No. 27/2015/TT-BTNMT.
Receiving and appraisal agency
Depending on the scale and location of the project, the receiving and appraisal agency is one of the following agencies:
Department of Natural Resources and Environment
Industrial Park Management Board
Economic Zone Management Board.

Depending on the scale, the licensing agency is one of the following agencies:
District People's Committee
Industrial Park Management Board
Economic Zone Management Board.
Penalties for violations
A fine of VND 40,000,000 to VND 50,000,000 shall be imposed for not having an approved Environmental Plan as prescribed.
Detailed penalties are provided in Article 12 of Decree 179/2013/ND-CP dated November 14, 2013 of the Government regulating administrative sanctions in the field of environmental protection.
