Subject of implementation

• Applicable to domestic agencies, organizations and individuals and foreign organizations and individuals (hereinafter referred to as organizations and individuals) with activities related to the discharge of wastewater into water sources within the territory of the Socialist Republic of Vietnam.

Legal basis

• Law on Water Resources No. 17/2012/QH13 was passed by the National Assembly of the Socialist Republic of Vietnam on June 21, 2012, effective from January 1, 2013.
• Decree No. 201/2013/ND-CP of the Government detailing the implementation of a number of articles of the Law on Water Resources Decree No. 18/2015/ND-CP dated February 14, 2015 of the Government regulating environmental planning, environmental impact assessment, environmental protection plans, effective from February 14, 2015.
• Circular No. 27/2014/TT-BTNMT dated May 30, 2014 of the Ministry of Natural Resources and Environment regulating the registration of underground water exploitation, application form for granting, extending, adjusting, and re-granting water resources licenses.

Application form

• Application for a license (Form No. 09 of Circular 27/2014/TT-BTNMT);
• Results of water quality analysis at the wastewater receiving location according to State regulations at the time of application for a license;
• Regulations on sanitary protection zones (if any) prescribed by competent authorities at the proposed wastewater discharge location;
• Project for wastewater discharge into water sources, accompanied by the wastewater treatment system operation process in cases where there is no wastewater discharge facility or there is a wastewater discharge facility but there is no wastewater discharge activity (Form No. 35 of Circular 27/2014/TT-BTNMT);
• Or Report on wastewater discharge into water sources (Form No. 36 of Circular 27/2014/TT-BTNMT), accompanied by the results of wastewater composition analysis and a certificate of payment of environmental protection fees for wastewater (notarized photocopy) in case wastewater is being discharged and there is a wastewater treatment facility;
• Map of the location of the area applying for a wastewater discharge permit into water sources at a scale of 1/10,000 according to the VN 2000 coordinate system;
• Environmental impact assessment report approved by a competent authority or a registration of environmental standards according to regulations of the law on environmental protection;
• Notarized copy of the certificate, or valid documents on land use rights according to regulations of the law on land at the location of the wastewater discharge facility;
• In case the land at the location of the wastewater discharge facility is not under the land use rights of the organization or individual requesting permission, there must be a written agreement on land use between the organization or individual discharging wastewater and the organization or individual having the right to use the land, confirmed by the People's Committee of the commune or ward where the facility is located;

Time for appraisal and approval of documents

• The term of the license shall not exceed 10 years and shall be reviewed and extended for no more than 5 years. At the time of application for extension, the old discharge license shall be valid for at least 3 months.
