Subject of implementation

• For the cases specified in Column 4, Appendix II of Decree No. 18/2015/ND-CP dated February 14, 2015 of the Government, the project owner must report the results of implementing environmental protection works serving the project operation phase based on the approved environmental impact assessment report and approved adjustment proposals (if any) to the agency approving the environmental impact assessment report for inspection and confirmation of completion before putting the project into official operation.
• For investment projects with multiple phases, reporting the results of implementing environmental protection works serving the project operation phase is carried out for each phase of the project.

Legal basis

• Law on Environmental Protection No. 55/2014/QH13 was passed by the National Assembly of the Socialist Republic of Vietnam on June 23, 2014, effective from January 1, 2015.
• Decree No. 18/2015/ND-CP dated February 14, 2015 of the Government regulating environmental planning, environmental impact assessment, and environmental protection plans.
• Circular No. 26/2015/TT-BTNMT dated May 28, 2015 of the Ministry of Natural Resources and Environment regulating detailed environmental protection projects and simple environmental protection projects, effective from July 15, 2015.
• Circular No. 27/2015/TT-BTNMT dated May 29, 2015 of the Ministry of Natural Resources and Environment detailing environmental protection planning, strategic environmental assessment, environmental impact assessment and environmental protection plan, effective from July 15, 2015.

Condition

• The facility implements environmental protection works and measures fully and correctly as stated in the approved Environmental Impact Assessment Report/Detailed Environmental Protection Plan
• Environmental treatment works must ensure that the treatment meets current environmental standards

Required documents

• Business registration certificate/ Investment license.
• Land use right certificate/ Land lease contract.
• Environmental impact assessment report/Detailed environmental protection plan or Certificate of environmental protection commitment/Simple environmental protection plan that has been issued.
• Decision approving environmental impact assessment/Detailed environmental protection plan or Certificate of environmental protection commitment/Simple environmental protection plan that has been issued.
• Groundwater exploitation license, discharge license
• Hazardous waste source owner registration book
• Contract for collection and treatment of hazardous waste, non-hazardous production solid waste and domestic solid waste
  Construction acceptance document, fire prevention and fighting acceptance
• Completion drawing of overall layout, rainwater and wastewater drainage
• Completion drawing of environmental treatment systems.
• Explanation or instructions for operation of environmental treatment works and systems

Application form

• One (01) written request for inspection and confirmation of completion of environmental protection works, made according to the form specified in Appendix 3.1 of Circular No. 27/2015/TT-BTNMT;
• One (01) copy of the approval decision with a copy of the approved environmental impact assessment report of the project;
• Seven (07) copies of reports on the results of implementing environmental protection works serving the operation phase of the project, made according to the form specified in Appendix 3.2 of Circular No. 27/2015/TT-BTNMT. In case the project is located in two (02) or more provinces or centrally-run cities, the project owner must submit an additional number of reports equal to the number of additional provinces to serve the inspection work.

Time for appraisal and approval of documents

• No more than fifteen (15) working days from the date of receipt of the dossier reporting the results of the implementation of environmental protection works serving the project operation phase in cases where it is not necessary to take samples and analyze environmental indicators for verification;
• No more than thirty (30) working days from the date of receipt of the dossier reporting the results of the implementation of environmental protection works serving the project operation phase in cases where it is necessary to take samples and analyze environmental indicators for verification.
